New York Governor Signs Bill Requiring Disclosure of AI-Generated Performers in Advertising

On December 11, 2025, Governor Kathy Hochul signed New York’s Synthetic Performer law (S.8420-A / A.8887-B) into law, continuing the state’s broader effort to regulate the use of artificial intelligence in the creative industries. The law requires advertisements to include a conspicuous disclosure when “synthetic performers” are used and authorizes civil penalties of $1,000 for a first violation and $5,000 for each subsequent violation. The measure follows closely on the heels of New York’s Fashion Workers Act, which restricts the creation and use of AI-generated digital replicas of human fashion models without express consent; Both bills have received public support from SAG-AFTRA as part of its broader advocacy for transparency around AI in media and performance.
