White House Issues Executive Order on State AI Law Preemption

On December 11, 2025 , the White House announced a sweeping executive order, titled Ensuring a National Policy Framework for Artificial Intelligence, that aims to reign in the growing patchwork of state artificial intelligence laws. The order directs federal agencies to challenge and potentially halt enforcement of state AI laws deemed “burdensome,” while signaling a broader push toward federal preemption in the name of innovation and U.S. AI leadership. The final order also includes a new clarification on the limits of federal preemption, affirming that certain categories of state authority—such as laws addressing children’s online safety and state government procurement and use of AI—are not intended to be displaced by future federal action.
