EEOC Proposes Regulations for the Pregnant Workers Fairness Act

On August 11, 2023, the U.S. Equal Employment Opportunity Commission (EEOC) published its proposed regulations to implement the Pregnant Workers Fairness Act (PWFA). The PWFA was passed by Congress in late 2022 as part of the omnibus spending bill and went into effect on July 27 of this year. The PWFA grants pregnant and postpartum workers the right, at the federal level, to have access to reasonable accommodations to address “the known limitations related to the pregnancy, childbirth, or related medical condition”, unless the accommodation will cause the employer an “undue hardship.” The PWFA covers all private employers in the U.S. with 15 or more employees, federal public employees, as well as part-time, temporary and seasonal workers and job applicants.
