California Privacy Agency Advances Draft Privacy Regulations

On March 8, 2024, the California Privacy Protection Agency’s (CPPA) board advanced new draft regulations that implement the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”) on policy areas including automated technology and privacy risk assessments. The board vote to move forward with the new draft regulations on data risk assessments and automated decisionmaking technologies was 3 to 2. Another board vote to advance some amendments to the existing CCPA regulations was unanimous. In each case , CPPA staff was authorized to prepare the materials necessary under administrative procedures laws and regulations to publish a notice of proposed rulemaking; the publication will be subject to a further Board vote after reviewing the rule making package.
